Irby construction workers, owners suing over unpaid wages
Workers in an Indianapolis construction company have filed a lawsuit against owner John Irby and his brother Robert claiming the construction firm owes them unpaid wages, overtime, and other forms of compensation.
Irby, a self-proclaimed “real estate king,” is also facing a lawsuit filed by his sister and two of their sons.
A representative for Irby told Vice News that the lawsuit is being brought against Robert Irby, Robert Irbys brother and a subsidiary of the construction company.
According to the lawsuit, Robert and John Irbys sons have been working in the Irby Construction Company since 2006.
In addition to claiming unpaid wages and overtime, the brothers are seeking a jury trial for unspecified damages.
The Irbys own and operate the Irbys, a property management company, according to the suit.
“In the year between 2009 and 2014, Irby’s brothers Robert and Joseph Irby engaged in fraudulent activity that led to Irby being insolvent and ultimately losing all of its assets, including Irby,” the lawsuit states.
“In an attempt to recover from Irby in bankruptcy, Irbys brothers sought to enter into a joint venture agreement with the New Jersey company, Irbis Inc. (JI),” the complaint states.
John Irbys son Joseph is also the CEO of Irbys Inc. according to a statement from Irbys.
Joseph Irbys’ statement to Vice News reads in part: “In January 2018, the Irbis brothers, who are now deceased, filed for bankruptcy protection.
Since then, Iras have attempted to file for bankruptcy, but they are currently being denied.
Irbis is an independent company that is not part of Irbis and is not affiliated with Irbys family or any family member.”
The Irbis filed for Chapter 11 bankruptcy protection in October 2018.
In a statement, the company said, “Irbis is one of the largest property management companies in the United States and is located in Indianapolis, Indiana.”
Irby told the Indianapolis Star in December 2018 that he was not involved in any wrongdoing, and that he had “no knowledge” of any problems with Irbis or Irbys workers.
He added that he hoped to be able to work with Irbys family again.
At least one of Irby s sons was arrested on child pornography charges, and the Irbits have also been linked to the criminal activities of the notorious “Vic Tamburello Gang,” which allegedly operated a sex trafficking ring from the 1980s to the early 2000s.
The Irby brothers have also faced allegations that they failed to pay workers for work that they were required to do for Irbys construction projects.
In December 2018, a federal judge ruled that Robert Iras sons failed to file federal income tax returns, and Iras had failed to disclose his ownership of the company in its annual financial reports.
Irbys and his siblings have also filed lawsuits against several Indiana companies and individuals over allegations of tax fraud.
